José Maura elected as new Director of the IOPC Funds

27 October 2011

The 1992 Fund Assembly has elected Mr José Maura Barandiarán of Spain as the next Director of the IOPC Funds. Mr Maura will officially take up his duties as Director on 1 November 2011.

José Maura, who is 50, has worked for the IOPC Funds for 15 years and prior to joining the Funds, practised law and worked for a Protection and Indemnity Club. He joined the IOPC Funds as a Claims Manager in February 1996 and became the Head of the Claims Department in January 2002.  In the absence of the current Director, Mr Willem Oosterveen, due to illness, on 21 September 2010 Mr Maura was appointed Acting Director of the IOPC Funds and on 26 October 2011 was elected Director for a term of five years.

Following his election Mr Maura expressed his gratitude to the 1992 Fund Member States for the confidence and trust they had shown by electing him.  He declared that it was a great honour and privilege and that he was committed to providing a high-quality service to all Member States.

Mr Maura stated that 'the foremost duty of the Director is to manage the Secretariat so that the IOPC Funds operate smoothly for the benefit of victims of pollution damage, thus doing justice to the spirit of the Conventions governing the international compensation regime.  In my opinion, it is very important that as many Member States as possible are involved in the core decision-making process of the IOPC Funds and that the excellent relationship between the Funds and all relevant parts of the industry should continue in the future for the benefit of the international community.'  He specifically referred to the excellent relationship with IMO as the recognised mother organisation of the IOPC Funds.

Mr Maura admitted that preparing for the election had been challenging and commended Mr Fréderic Hébert, Director of REMPEC, also a candidate for the position, for showing the courage to present himself as a candidate and providing Member States with a choice.

He expressed his appreciation for his highly qualified colleagues in the Secretariat upon who he said he relied for support and cooperation, particularly during the period since September 2010, which had been demanding both for him as Acting Director and for the Secretariat.  He further declared 'I know I can count on their expertise and dedication and that together we can ensure that working for the Funds is interesting, challenging, rewarding and a great pleasure.  The IOPC Funds are truly remarkable Organisations which fulfil a very important role in the international community.  Nothing will give me greater satisfaction than to be able to direct all my energy towards serving the Funds and all they stand for.'

'I know I have a demanding task ahead but with Members’ support and the help from my colleagues in the Secretariat I will succeed.'

1992 Fund 7th intersessional Working Group

28 October 2011

At the 16th session of the 1992 Fund Assembly, the Assembly decided to establish the 7th intersessional Working Group to consider issues relating to the definition of ‘ship’.

The terms of reference for the intersessional Working Group were approved by the Assembly and can be found at Annex III to the Record of Decisions of the October 2011 sessions of the IOPC Funds’ governing bodies (document IOPC/OCT11/11/1). Further background information on the issues which the Working Group will be dealing with can be found in documents IOPC/OCT10/4/3 and IOPC/OCT11/4/4, submitted by the Director and IOPC/OCT10/4/3/1, submitted by the delegation of Denmark.

The Working Group, under the chairmanship of Mrs Birgit Sølling Olsen (Denmark), will report its findings and/or recommendations to each regular session of the 1992 Fund Assembly, with a view to determining whether continuation of the Working Group is considered appropriate.

The Working Group will be open to all 1992 Fund Member States. In addition, all former 1971 Fund Member States, intergovernmental organisations and international non-governmental organisations which have observer status with the 1992 Fund will be invited to attend the Working Group as observers.

The first meeting of the Working Group is scheduled to take place during the week of 23 April 2012.

Global settlement reached in respect of the Erika incident

25 October 2011

On 14 October 2011 the Acting Director signed on behalf of the 1992 Fund a global settlement with Steamship Mutual (acting on its own behalf and also on behalf of the shipowner's interests), Registro Italiano Navale (RINA) and Total, in respect of the Erika incident.

The Erika sank on 12 December 1999 in the Bay of Biscay, some 60 nautical miles off the coast of Brittany, France.  Some 400 kilometres of shoreline were polluted by the oil, causing a considerable impact in particular on businesses in the fisheries and tourism sector.

The total amount available to pay compensation for this incident under the 1992 Civil Liability and Fund Conventions is some €184.7 million.  Payments of compensation have been made for a total of €129.7 million. Therefore, there now remains some €55 million available for compensation.

The main objective of the global settlement is to ensure that civil parties who, by the judgement of the Criminal Court of Appeal in Paris in March 2010, had been awarded compensation for damage caused as a result of the incident, received such compensation as soon as possible.

Under the general four party agreement, the 1992 Fund, Steamship Mutual, RINA and Total have undertaken to withdraw all proceedings against the other parties to the agreement and, in addition, have waived any rights to bring any claim or action which they might have in relation to the Erika incident against any of the other parties to the agreement.  Under the agreement the 1992 Fund will continue to handle the 13 pending legal actions brought against it, totalling some €19.9 million, and will pay in accordance with judgements.

The 1992 Fund Executive Committee has expressed its satisfaction about the conclusion of such a settlement as it will facilitate prompt payment of compensation to victims, which is the primary mission of the IOPC Funds.
